Privacy Policy

GardinDS LLC, doing business as OpenCalls (“OpenCalls,” “we,” “us,” or “our”), provides AI-powered receptionist and related business communication services. This Privacy Policy explains how we collect, use, disclose, and retain personal information when you visit our website, communicate with us, purchase or use our services, or call or message a business that uses OpenCalls.
This Policy is designed to describe our actual practices, including processing performed through our underlying AI-receptionist platform, Ulio/TZL Media LLC (“Ulio”). It does not replace a customer’s own privacy notice or legal duties to its callers, employees, customers, or prospects.
1. SCOPE AND ROLES
This Policy applies to:
• visitors to https://www.opencalls.work and people who submit a contact, onboarding, support, or other form;
• prospective and current OpenCalls customers and their owners, employees, contractors, and authorized users;
• people who call, text, leave voicemail for, or otherwise communicate with a business through a phone number or workflow operated using OpenCalls; and
• people who receive an operational response or follow-up that they requested or otherwise lawfully consented to receive.
The business you intended to contact generally decides why the communication occurs, what the AI receptionist should ask, who receives the resulting information, and how the information is used. That business is responsible for its relationship with you, its own privacy notice, and its legal basis for processing. OpenCalls and its providers process information to deliver, secure, support, bill for, and improve the service. Depending on the law and activity, the business, OpenCalls, and a provider may be described as controllers, businesses, processors, service providers, contractors, or independent recipients for limited purposes.
This Policy does not apply to a third-party website, application, or service merely because it links to or integrates with OpenCalls. Those third parties have their own policies.
2. INFORMATION WE COLLECT
The information we collect depends on how you interact with us and how a customer configures the service.
A. CUSTOMER AND ACCOUNT INFORMATION
We may collect names, business names, job titles, email addresses, phone numbers, business addresses, login or account identifiers, authorized-user details, plan information, support history, onboarding responses, business hours, service areas, escalation contacts, call-routing instructions, scripts, frequently asked questions, and other configuration information.
B. BILLING AND TRANSACTION INFORMATION
We use Stripe to process payments. We may receive transaction identifiers, payment status, billing contact information, subscription status, last four digits and brand of a payment method, tax information, disputes, refunds, and related records. OpenCalls does not ordinarily receive or store full payment-card numbers.
C. CALL, MESSAGE, AND APPOINTMENT INFORMATION
Depending on customer configuration and applicable law, we and our providers may process:
• caller and recipient phone numbers;
• call audio and voicemail;
• recordings, transcripts, summaries, and extracted call details;
• text-message content and delivery or opt-out status;
• caller name, callback number, city, postal code, service address, requested service, urgency, preferred appointment date or time, and information the caller chooses to provide;
• call time, date, duration, routing, transfer, disposition, carrier, and similar metadata; and
• notifications, follow-up status, and authorized recipient information.
The receptionist may be configured to request different information. Callers should not provide passwords, authentication codes, Social Security numbers, full payment-card or bank-account information, government identification numbers, protected health information, or other unnecessary sensitive information.
D. WEBSITE, DEVICE, AND USAGE INFORMATION
When you visit our website or use a hosted service, we and our providers may automatically collect IP address, browser and device type, operating system, pages or features used, referring page, approximate location derived from IP address, dates and times, error logs, cookies, and similar technical or interaction data.
E. COMMUNICATIONS AND SUBMITTED CONTENT
We collect the content of emails, forms, support requests, sales conversations, feedback, files, website material submitted for knowledge-base creation, and other communications you send to us.
F. INFORMATION FROM CUSTOMERS, PROVIDERS, AND PUBLIC SOURCES
We may receive information from the OpenCalls customer you contacted, Ulio, Stripe, telecommunications carriers, hosting and form providers, email providers, analytics or security providers, referral partners, and publicly available business sources. We do not treat the public availability of a phone number as consent to automated marketing.
3. HOW WE USE INFORMATION
We may use personal information to:
• provide, configure, operate, test, maintain, and support the OpenCalls service;
• answer and route inbound calls, process caller requests, generate transcripts and summaries, send authorized notifications, and support requested appointments or follow-ups;
• create and administer accounts, subscriptions, payments, taxes, refunds, disputes, and collection activity;
• authenticate users, prevent spam, abuse, fraud, and security incidents, troubleshoot errors, and protect the service and its users;
• respond to questions, support requests, privacy requests, and other communications;
• personalize and improve prompts, workflows, product performance, documentation, and customer experience;
• create aggregated or de-identified analytics and operational information;
• comply with law, lawful process, carrier or provider requirements, and enforce our agreements; and
• establish, exercise, or defend legal claims.
Where applicable law requires consent, we rely on consent for the particular processing. In other circumstances, processing may be necessary to perform a contract, comply with law, protect legitimate interests, or fulfill a request made by you or the business you contacted.
4. ARTIFICIAL INTELLIGENCE, RECORDING, AND TRANSCRIPTION
Callers may interact with an automated or AI-generated voice. OpenCalls requires a clear initial disclosure that the receptionist is AI-powered and, when applicable, that the call may be recorded or transcribed. The customer must not remove or contradict that disclosure and remains responsible for any additional notice or consent required by the caller’s location or the customer’s industry.
AI systems can misunderstand speech, omit information, or generate inaccurate outputs. Customers are responsible for human review of appointments, quotes, commitments, emergencies, sensitive matters, and other consequential decisions.
OpenCalls does not authorize call recordings, call transcripts, or end-user SMS opt-in data to be used to train third-party artificial-intelligence models. Ulio currently states that it does not use those categories to train third-party AI models. Ulio may use aggregated or de-identified information to improve its own internal models and systems. OpenCalls and its providers may also use aggregated or de-identified operational information that does not reasonably identify a person or customer to operate, secure, measure, and improve their services. We do not intentionally re-identify de-identified information.
5. WHEN WE DISCLOSE INFORMATION
We may disclose information in the following circumstances.
A. THE CUSTOMER AND ITS AUTHORIZED RECIPIENTS
We provide call details, recordings or transcripts if enabled, summaries, messages, appointment information, notifications, and service data to the business the caller contacted and people that business authorizes. A customer administrator may be able to access information processed through that customer’s service.
B. SERVICE PROVIDERS
We use providers that process information for business purposes such as:
• Ulio/TZL Media LLC, for the underlying AI-receptionist platform, telecommunications workflows, call and message processing, hosting, AI functions, support, security, and related operations;
• Stripe, for checkout, subscription billing, payment processing, customer portal functions, fraud prevention, and tax or dispute administration; and
• providers of telecommunications, voice generation, AI processing, cloud hosting, website hosting, forms, email, analytics, logging, security, support, and professional services.
These providers may process information in the United States and other jurisdictions where they or their subprocessors operate. Their access is limited to the purposes for which they provide services or as otherwise permitted by law and their applicable agreements.
C. BUSINESS TRANSFERS
We may disclose information in connection with an actual or proposed merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or transfer of all or part of our business, subject to appropriate confidentiality and legal requirements.
D. LEGAL, SAFETY, AND ENFORCEMENT REASONS
We may disclose information when we reasonably believe it is necessary to comply with law or lawful process; respond to a valid government request; protect the rights, safety, security, or property of OpenCalls, a customer, a caller, a provider, or the public; investigate fraud, abuse, or a security incident; or establish, exercise, or defend legal claims.
E. AT YOUR DIRECTION OR WITH CONSENT
We may disclose information when a customer or individual directs us to do so, requests an integration or transfer, or gives valid consent.
6. SALE, TARGETED ADVERTISING, AND MOBILE OPT-IN DATA
OpenCalls does not sell personal information for money. We do not share personal information for cross-context behavioral advertising or use caller communications for targeted advertising. We do not disclose mobile numbers, SMS opt-in records, or consent data to third parties for their own marketing or promotional purposes.
We may disclose information to service providers that help us operate communications requested by a customer or caller. That operational disclosure is not permission for a provider to market independently to the caller.
7. OUTBOUND CALLS, TEXT MESSAGES, AND OPT-OUTS
OpenCalls is primarily designed for inbound receptionist services and caller-requested operational follow-up. Customers may not use OpenCalls for cold automated marketing, artificial- or prerecorded-voice solicitations, bulk messages, or ringless voicemail without a written OpenCalls authorization and legally sufficient consent for each recipient.
If you receive a marketing text supported by the service, you may reply STOP to opt out. Other customary opt-out words may also be recognized. You may contact the business identified in the message or OpenCalls if an opt-out is not honored. Consent to receive marketing communications is not a condition of purchasing an unrelated good or service unless applicable law permits otherwise.
8. COOKIES AND SIMILAR TECHNOLOGIES
Our website and providers may use cookies and similar technologies that are necessary for site operation, security, preferences, forms, performance, or analytics. Browser settings may allow you to block or delete cookies, but doing so can affect site functionality. If we introduce advertising or nonessential tracking that requires consent, we will provide the choice required by applicable law.
9. RETENTION
We retain information only as long as reasonably necessary for the purposes described in this Policy, including to provide and secure the service; maintain account, billing, tax, and audit records; comply with law and provider requirements; resolve disputes; prevent fraud and abuse; enforce agreements; and maintain reasonable backups.
Retention depends on the type of information, customer instructions, account status, legal obligations, dispute or security holds, technical backup cycles, and provider capabilities. A customer may choose its own retention practices for copies it receives. De-identified information that cannot reasonably identify a person or customer may be retained for a longer period, including indefinitely where permitted by law.
When information is no longer needed, we take reasonable steps to delete it, de-identify it, or isolate it from active use, subject to legal and technical limitations.
10. SECURITY
We use reasonable administrative, technical, and organizational safeguards designed for the nature of the service and information processed. Those measures may include access controls, provider security reviews, account controls, logging, encryption supplied by our providers, and incident-response procedures. No transmission, provider, AI system, telecommunications network, or storage system is completely secure, and we cannot guarantee absolute security.
Customers are responsible for protecting their accounts and authorized recipient addresses, using strong credentials where available, limiting internal access, and promptly reporting suspected compromise. Do not send unnecessary sensitive information through ordinary email or forms.
11. SENSITIVE AND REGULATED INFORMATION
OpenCalls is not an emergency service and should not be used to collect passwords, authentication codes, Social Security numbers, full financial-account information, or other high-risk credentials.
Do not use the service to request, intentionally collect, or process protected health information regulated by HIPAA unless OpenCalls has signed a Business Associate Agreement and confirmed in writing that every necessary provider in the processing chain supports the approved configuration. OpenCalls signing ordinary Terms, a customer’s separate agreement with another vendor, or a customer’s status as a healthcare business does not create a Business Associate Agreement.
If a caller volunteers sensitive information, the customer should minimize further collection and contact OpenCalls if deletion or special handling may be appropriate.
12. PRIVACY CHOICES AND RIGHTS
Depending on where you live and subject to legal exceptions, you may have the right to request that we:
• confirm whether we process your personal information;
• provide access to or a portable copy of certain information;
• correct inaccurate information;
• delete certain information;
• restrict or object to certain processing;
• explain or appeal a decision about a privacy request; or
• honor a legally recognized opt-out preference signal where it applies to processing we perform.
You may submit a request through https://www.opencalls.work/contact or by emailing ryan@opencalls.work with the subject line “Privacy Request.” Describe your relationship with OpenCalls and the business or phone number involved. We may request information reasonably necessary to verify identity, authority, and scope. We will not discriminate against you for exercising an applicable privacy right.
An authorized agent may submit a request where permitted by law, but we may require proof of authorization and direct identity verification. If the information is controlled by an OpenCalls customer, we may direct the request to that customer or assist the customer as required by our role and applicable law.
We may deny or limit a request where an exception applies, such as when information is needed for security, fraud prevention, legal compliance, billing, dispute resolution, or the rights of another person. If applicable law provides an appeal right, you may appeal by replying to our decision with “Privacy Appeal” in the subject line.
13. CHILDREN
OpenCalls is a business service and is not directed to children under 16. We do not knowingly collect personal information from children under 16 for their own use of OpenCalls. If you believe a child has provided personal information to us, contact us so we can evaluate and take appropriate action.
14. INTERNATIONAL PROCESSING
OpenCalls is operated from the United States. We and our providers may process information in the United States and other countries whose privacy laws may differ from those in your location. Where required, we use an appropriate legal mechanism for international transfers. Customers should not deploy the service in a jurisdiction that requires a transfer mechanism or local compliance measure unless it has confirmed that the configuration is lawful.
15. CHANGES TO THIS POLICY
We may update this Policy to reflect changes in law, providers, features, or practices. We will post the updated Policy with a new Last updated date. If a change materially expands how we use or disclose information already collected, we will provide additional notice or obtain consent when required by law. Material contract changes are governed by the notice and acceptance provisions in the OpenCalls Terms of Service.
